THE LABATT GOLF TOURNAMENT SWEEPSTAKES
NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE.
A PURCHASE WILL NOT INCREASE CHANCES OF WINNING.
MUST BE 21 YEARS OF AGE OR OLDER AT TIME OF ENTRY AND HAVE AN INTERNET CONNECTION.

ELIGIBILITY: The Labatt Golf Tournament Sweepstakes (“Sweepstakes”) begins at 12:00:01 AM Eastern Time ("ET") on 05/06/2024 (“Start Date”) and ends at 11:59:59 PM ET on 09/30/2024 (“End Date”) (“Promotion Period”). Sweepstakes is open to legal US residents of CT, IL, MA, MI, NH, OH, PA, VT, & WI who are 21 years of age or older at time of entry. This Sweepstakes is sponsored by Labatt USA Operating Company, Buffalo, New York (“Sponsor”). Employees, officers, directors, and representatives of Sponsor, Sponsor’s agents, Sponsor’s advertising/promotion agencies, and alcoholic beverage licensees including their parent, subsidiary, and affiliated companies, and the immediate family members of the foregoing employees, officers, directors, and representatives residing in the same household (collectively, the “Released Parties”) are not eligible to participate in this Sweepstakes. By participating, entrants agree to these Official Rules and the decisions of the Sponsor. Individuals may only win once during the promotion.

PRIZES AND DRAWINGS: Subject to confirmation of eligibility, one (1) (“Winner”) will be selected per Entry Period, for a total of (2) Winners during the Sweepstakes. Each Winner will be selected in accordance with the Entry Period schedule detailed below.

On or after the End Date of each Entry Period, one (1) Winner will be randomly selected from all eligible entries received during that corresponding Entry Period. Each Winner will be notified by phone, text-message, or email and entrants hereby consent to such notification by entering into this Sweepstakes. Each Winner will be awarded the following prize package (collectively the “Prize”): Foursome to specific charity golf tournaments sponsored by Labatt. The Approximate Retail Value (“ARV”) of each Prize is $1,000.00. The total ARV of all Prizes is $1,000. The odds of winning a Prize will depend on the total number of eligible entries received during the corresponding Entry Period. All Prizes will be awarded unless Sponsor cannot obtain documentation from a potential Winner to prove eligibility in which case all Prizes may not be awarded. Winner is responsible for all costs and expenses incurred that are not specifically stated as being included as part of the Prize including, but not limited to, travel to and from the golf tournament, all taxes, surcharges, and all other costs and expenses not specifically stated as being included. Prize will be mailed to Winner at residence provided by Winner. No alcohol is being awarded as a Prize.

CONDITIONS: Winner and Guests must be 21 years of age or older at time of entry. There is a limit of one (1) Prize per person or household. Guest(s) will have no independent rights to the Prize. No substitutions are allowed and the Prize will be invalid if, other than providing a single ticket to each Guest, the Winner sells, transfers, or auctions the Prize for consideration after receipt. Guest(s) must accompany Winner to the tournament. The tickets awarded as a portion of the Prize must be used for the same tournament. Winner and Guest(s) must comply with all terms and conditions listed on the tickets. Sponsor reserves the right to substitute the Prize with a prize of equal or greater value or with a company check in the amount of the ARV for the Prize. In the event there is any difference between the actual value of the Prize and the ARV, no refund for any difference will be provided. Winner will be required to provide proof of identity, age, and residency. If Sponsor is unable to receive personal confirmation from a Winner of being selected as a Winner within three (3) days from Sponsor’s first notification attempt, or if a Winner (i) fails to complete and return all requested documents by the date specified by the Sponsor, (ii) is found to be ineligible, or (iii) fails to comply with the Official Rules, the Prize will be forfeited and an alternate winner will be selected. If a Prize confirmation letter is returned as undeliverable, the Prize will be forfeited and Sponsor will select an alternate winner. Acceptance of the Prize constitutes permission for Sponsor to use Winner’s name and address (city and state) for promotional purposes on a worldwide basis, and in all forms of media in perpetuity, without notice or further compensation. Sponsor will issue an IRS Form 1099 for prizes valued in excess of $600.00. Each Winner, and Winner’s guests, if any, will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release within three (3) days from the date of receipt. Tournament dates are subject to change at Sponsor’s sole discretion. All federal, state, and other taxes are the responsibility of each Winner. Prizes awarded may not be exactly as shown or described. No substitutions are allowed and the Prize may not be transferred, conveyed, or auctioned. A purchase will not increase chances of winning. Prize is subject to availability. By participating, entrants agree to waive any right to claim ambiguity in regard to the mechanics of the Sweepstakes or the interpretation of the Official Rules. Sponsor does not provide tax advice. Entrants are encouraged to contact their own advisor regarding potential tax implications, if any, of this Sweepstakes. Winners agree to release, discharge, indemnify, and hold harmless the Sponsor, Instagram, Inc., their respective parent companies and affiliates and their respective directors, officers, employees, and agents, from any claims due to any injuries, damages or losses to any person (including death) or property, resulting in whole or in part from acceptance or use of the Prize, or participation in the Sweepstakes. External links may be subject to additional terms and conditions. Sponsor is not liable for any material, terms, conditions, or any other losses or damages as a result of visiting the external site. No purchase is necessary. A purchase will not increase chances of winning. ENTRANT WARRANTY AND RELEASE: Each entrant warrants that he/she is eligible to participate in this Sweepstakes and has the legal capacity to agree to the terms of these Official Rules. Winner agrees to release, indemnify, and hold harmless the Released Parties from any and all liability, injuries, losses, or damages to any person (including death) or property, arising from or in connection with the awarding, receipt, use, and/or misuse of a prize or participation in any prize-related activity, and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property related cause of action.

LIMITATIONS ON LIABILITY: Released Parties are not responsible for lost, late, jumbled, incorrect, or inaccurate entries, whether caused by any of the equipment or programming associated with or utilized in this Sweepstakes or by any human error. Sponsor is not responsible for any problems or technical malfunction(s) of any telephone network or lines, computer online systems, servers or other services, providers, computer equipment, software, failure of any e-mail, technical problems or traffic congestion on the Internet or at any website (including Instagram), including, without limitation, any injury or damage to participant's or any other person's computer related to or resulting from participation in this Sweepstakes. Sponsor is not responsible for any typographical or other error(s) in administration of the Sweepstakes, or in the selection/announcement of the prize winners. If, for any reason, the Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted where Sponsor deems fit and the prizes will be awarded via random drawing from among all eligible Entries received up until and or after (if applicable) the time of modification, cancellation or termination, or in a manner that is fair and equitable as determined by Sponsor. If for any reason during any given Entry Period there is no Labatt Golf Tournament Sweepstakes Instagram post, no entries will be collected and no Prize will be awarded. The Sweepstakes Promotion Period will not be extended and the applicable Entry Period will be deemed canceled. All Entries become the property of the Sponsor and will not be returned to entrants. The Sweepstakes is subject to all applicable federal, state and local laws. Any person attempting to defraud or in any way tamper with the mechanics or logistics of this Sweepstakes will be declared ineligible and may be prosecuted. Sponsor is not responsible for lost or stolen Prizes. ** If, for any reason, the Sweepstakes is not capable of being conducted as planned because of tampering, intervention, fraud, technical failures, or any other reason (each an “Intervening Cause”), which affects the security, fairness, or proper execution of the Sweepstakes, Sponsor reserves the right to modify or cancel the Sweepstakes or otherwise award the Prizes through a drawing from all eligible entries received which, in Sponsor’s discretion, were not affected by the Intervening Cause.** With regard to the Prize being awarded, Sponsor makes no express or implied warranty of merchantability or fitness for a particular purpose. Prize is awarded “As Is”. Sponsor is not responsible for any damage, malfunctions, missing parts or any other physical or mechanical flaws of Prize. Any photographs used are for illustrational purposes only and may differ from the actual Prize awarded. In the event that a court, or other tribunal of competent jurisdiction, shall hold any of the provisions of these Official Rules to be illegal, invalid, or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Official Rules shall otherwise remain in full force and effect.

DISPUTE RESOLUTION: Any disputes regarding this Sweepstakes shall be governed by New York State law and resolved in State or Federal court located in Erie County, New York. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred but in no event attorneys’ fees. Entrant waives any claim for punitive, incidental and consequential damages. BY PARTICIPATING, EACH ENTRANT UNDERSTANDS AND AGREES THAT HE/SHE MAY BRING A CLAIM AGAINST THE RELEASED PARTIES ON AN INDIVIDUAL BASIS ONLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.
