ELIGIBILITY: The Labatt Local Media-Sabres Experience Sweepstakes (“Sweepstakes”) is sponsored by Labatt USA (“Sponsor”). Sweepstakes is open only to legal residents of NY. Must be 21 years of age or older at time of entry. Sponsor, employees, officers, and directors of Sponsor, Sponsor’s agents, advertising/promotion agencies, and all of their respective officers, directors, representatives and employees, alcoholic beverage licensees, and the parent, subsidiary, and affiliated companies of the foregoing entities (collectively, the “Released Parties”), and the immediate family members of the foregoing, are not eligible to participate in this Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws, rules and regulations. Void wherever prohibited or restricted by law, rule or regulation. By participating, entrants agree to be bound by these Official Rules, which also can be found at www.labattusa.com/sabres, and the decisions of Sponsor.
HOW TO ENTER: The Sweepstakes begins at approximately 12:00 AM Eastern Time ("ET") on 01/22/2024 and ends at 11:59 PM ET on 03/15/2024 (“Sweepstakes Period”). There are two ways to enter the Sweepstakes: (1) visit www.labattusa.com/sabres, provide the information requested on the entry form, and submit. There is a limit of one entry per person per Entry Period (Entry Period is defined as one calendar day). In case of multiple entries from any one person or e-mail address per Entry Period, only the first entry will be accepted. Entries will be deemed made by the authorized account holder of the email address used at the time of entry. The “authorized account holder of the email address” is defined as the natural person who is assigned to the email address used to enter the Sweepstakes by an internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the email address used to enter the Sweepstakes; or (2) on your smart phone, scan QR Code located on participating Labatt USA Beer displays, click on the entry form, provide the information requested, and submit. QR Code reader software is required and messaging/data charges may be assessed by your mobile phone service provider. There is a limit of one entry per person per Entry Period. In case of multiple entries from any one person or mobile phone number, only the first entry will be accepted. Entries will be deemed made by the authorized account holder for the mobile phone number used at the time of entry. The “authorized account holder of the mobile phone number” is defined as the natural person who is assigned to the mobile phone number used to enter the Sweepstakes by the mobile phone service access provider associated with the mobile phone number used to enter the Sweepstakes. Entries generated by a script, macro or other mechanical or automated means will be disqualified. Any information shared with Sponsor for Sweepstakes administration purposes will be treated by Sponsor in a manner consistent with its Privacy Policy which can be found at www.fifcousa.com/privacy-policy.
PRIZES AND DRAWINGS: GRAND PRIZE. On or around the drawings dates set forth in the How To Enter section above (each, a "Drawing Date"), one (1) potential Grand Prize winner will be randomly selected from among all eligible entries received for the applicable Entry Period. There will be a total of 1 Grand Prize Winner (i.e., one (1) per Entry Period). Potential Grand Prize winner will be notified by phone or email. Subject to verification of eligibility and compliance with these Official Rules the potential Grand Prize winner will be declared the official Grand Prize winner (each, a "Grand Prize Winner"). The Grand Prize Winner will be awarded the following prize consisting of: An Exclusive Buffalo Sabres Gameday Experience For Them and Three Guests That Includes The Following: (4) Tickets To the Buffalo Sabres vs Philadelphia Hockey Game Scheduled For Friday April 5th, 2024 (Subject To Change); (4) Buffalo Sabres Jerseys; (4) Tickets To Sabres Access; And Other Opportunities As Provided Through The Buffalo Sabres (the “Grand Prize”). The Approximate Retail Value (ARV) of each Grand Prize is $1,000.00. The total ARV for all Grand Prizes is $1,000.00. Odds of winning a Grand Prize depend on the total number of eligible entries received for the applicable Entry Period. Transportation to/from any game, event or exhibition and lodging not included. Winner will be required to submit proof of age and residency in the manner specified by the Sponsor. Prizes will be awarded unless Sponsor cannot obtain documentation from the potential winner to prove age and residency, in which case the Prize may not be awarded. Winner is responsible for all costs and expenses not specifically stated as being included herein including, but not limited to, insurance, all taxes, surcharges, fuel, registration fees, transfer of title, licenses, delivery of Prize, and all other costs and expenses incurred in claiming, registering, or using the Prize. Seat locations at any game, event or exhibition will be determined in the sole discretion of Sponsor. Winner may obtain Prize by method of delivery. Winner assumes all responsibility for the legal and safe operation or handling of the Prize. No alcohol is being awarded as a Prize.

CONDITIONS: There is a limit of one (1) Entry per person or per day. Limit of (4) Entries per household per day. Non-winning eligible entries from each Grand Prize Drawing Date will not carry-over or be eligible for any subsequent Entry Period. Winner and Winner’s Guests, if any, must be 21 years of age or older at time of entry. No exceptions. Guests have no independent rights to any portion of the Prize. Guests must accompany Winners. No substitutions are allowed and the Prize will be invalid if the Winner sells, transfers, or auctions any portion of the Prize to another person other than a transfer to a Guest accompanying the Winner. Each Winner will be required to execute an Affidavit of Eligibility and Liability and, unless prohibited by law, Publicity Release and return same within five (5) days from receipt. If Sponsor is unable to receive personal confirmation from a Winner of being selected as a Winner within five (5) days from the first notification attempt, or if a Winner (i) fails to complete and return all requested documents by the date specified by the Sponsor, (ii) is found to be ineligible, (iii) fails to comply with these Official Rules or (iv) declines the Prize for any reason, the Winner will be disqualified, the Prize will be forfeited, and an alternate potential winner will be randomly selected, if time permits, from among all remaining eligible entries received for the drawing at issue. Winner agrees that Sponsor has the right for any reason, and in its sole discretion, to substitute a Prize with another prize of equal or greater value or with a company check in the amount of the ARV for the Prize. Winners and Guests must use the Prize awarded on the same day/night. No refund or reimbursement will be provided if any components of the Prize are not used for any reason or declined. No refund or reimbursement will be provided if there is a difference between the ARV of any Prize and the actual cost of the Prize. Each Winner will be required to provide his/her social security number and will be issued an IRS Form 1099 for Prizes valued in excess of $600.00. A purchase will not increase chances of winning. Any scheduled game and events and times are determined in the sole discretion of the Sponsor, as applicable, and may be subject to change. The terms and conditions of any tickets awarded as part of the Prize will govern in the event any game, event or exhibition, as defined by Sponsor, is not played or performed due to weather conditions, an Act of God, act of terrorism, civil disturbance or any other reason. Winner and Guests, if any, agree to comply with all applicable venue regulations in connection with the Prize. Sponsor reserves the right to remove or to deny entry to the Winner or Guest who engage in any disruptive manner, or act with intent to annoy abuse, threaten or harass any other person at any game, event or exhibition. Released Parties will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may affect Prize. Prize may not be resold or offered for resale. Any such resale may result in disqualification and Prize forfeiture.
ENTRANT WARRANTY AND RELEASE: Each entrant warrants that he/she is eligible to participate in this Sweepstakes and has the legal capacity to agree to the terms of these Official Rules. Winner agrees to release, indemnify, and hold harmless the Released Parties from any and all liability, injuries, losses, or damages to any person (including death) or property, arising from or in connection with the awarding, receipt and/or misuse of a prize or participation in any prize-related activity.
LIMITATIONS ON LIABILITY: By participating in the Sweepstakes and submitting an entry, each entrant agrees to (i) be bound by these Official Rules, including all entry requirements, and (ii) waive any and all claims against Released Parties for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Sweepstakes or from the receipt or use of the Prize (or any portion thereof), attendance at any Prize-related activity, or any travel or activity related to the receipt or use of the Prize (or any portion thereof). By entering this Sweepstakes, each entrant gives his/her express permission to be contacted by Sponsor by telephone, email and/or postal mail for Sweepstakes purposes. Each Winner, by acceptance of the Prize, grants to Sponsor and Sponsor’s designees the right to publicize the Winner’s name, address (city and state), photograph, voice, statements and/or other likeness and prize information for advertising, promotional, trade and/or any other purpose in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, unless prohibited by law. The Released Parties are not responsible for lost, late, delayed, inaccurate, incomplete, or misdirected entries, or for any electronic, network, or computer failures or malfunctions, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions that may limit a user’s ability to participate in this Sweepstakes, or for any other hardware, software, or technical errors of any kind including any injury or damage to any person’s computer related to or resulting from participating in the Sweepstakes, or for other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise, relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, or with respect to any Sweepstakes-related materials. All entries become the property of the Sponsor. Headings are provided for convenience only. Sponsor is not responsible or liable for any loss, damage, inconvenience, or loss of time arising out of any acts, omissions, or negligence, of any person, including, without limitation, any air and ground transportation carriers, any event venue, and any person providing any service or accommodation in conjunction with the Prize, or for delays or cancellations including, but not limited to those resulting from mechanical breakdown, closings, strikes, government action, inclement weather, sickness, injury, or Acts of God. Any person attempting to defraud or in any way tamper with the mechanics or logistics of this Sweepstakes will be declared ineligible and may be prosecuted. Released Parties are not responsible for lost or stolen Prizes. If, for any reason, the Sweepstakes is not capable of being conducted as planned because of tampering, intervention, fraud, technical failures, or any other reason (each an “Intervening Cause”), which affects the security, fairness, or proper execution of the Sweepstakes, Sponsor reserves the right to modify or cancel the Sweepstakes, or award the Prize through a random drawing from all eligible entries received which, in Sponsor’s opinion, were not affected by the Intervening Cause. With regard to the Prizes being awarded, Released Parties make no express or implied warranty of merchantability or fitness for a particular purpose. Any attempt to deliberately damage any website associated with this sweepstakes or undermine the content or legitimate operation of this sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Sponsor will disqualify any such entrant, and Sponsor and/or their respective agents reserve the right to seek damages (including attorneys’ fees) and other remedies from any person or persons responsible for the attempt to the fullest extent permitted by law.
DISPUTE RESOLUTION: Any disputes regarding this Sweepstakes shall be governed by New York State law and resolved in State or Federal court located in Erie County, New York. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred but in no event attorneys’ fees. Entrant waives any claim for punitive, incidental and consequential damages. BY PARTICIPATING, EACH ENTRANT UNDERSTANDS AND AGREES THAT HE/SHE MAY BRING A CLAIM AGAINST THE RELEASED PARTIES ON AN INDIVIDUAL BASIS ONLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.
