OHIO HOCKEY TICKETS SWEEPSTAKES

MUST BE 21 YEARS OF AGE OR OLDER AT TIME OF ENTRY AND HAVE AN INTERNET CONNECTION.
ELIGIBILITY: The Ohio Hockey Tickets Sweepstakes (“Sweepstakes”) begins at 12:00:01 AM Eastern Time ("ET") on 11/01/2023 (“Start Date”) and ends at 11:59:59 PM ET on 12/31/2023 (“End Date”) (“Promotion Period”). Sweepstakes is open to legal US residents of Ohio, who are 21 years of age or older at time of entry. This Sweepstakes is sponsored by Labatt USA Operating Company, Buffalo, New York (“Sponsor”). Employees, officers, directors, and representatives of Sponsor, Sponsor’s agents, Sponsor’s advertising/promotion agencies, Toledo Walleye Hockey Club, the National Hockey League and its member clubs and alcoholic beverage licensees including their parent, subsidiary, and affiliated companies, and the immediate family members of the foregoing employees, officers, directors, and representatives residing in the same household (collectively, the “Released Parties”) are not eligible to participate in this Sweepstakes. By participating, entrants agree to these Official Rules and the decisions of the Sponsor.
HOW TO ENTER: During the Promotion Period, there are two (2) ways to enter this Sweepstakes. Limit of two (2) entries per person and four (4) entries per household regardless of method of entry. You may only win once, regardless of Entry Method. As determined by Sponsor’s sole discretion, an Entry will be disqualified if the comment contains any content that: would be considered inappropriate, obscene, hateful, or indecent, promotes bigotry, racism, hatred or harm against any individual or group, infringes upon the rights of any other person or company, violates any law, defames, misrepresents, or contains disparaging remarks about any other person or company, or contains any trademarks or other copyrighted materials owned by others. The use of automated entry devices of any kind is prohibited. Incomplete entries will not be accepted, acknowledged, or returned. Entries must be received by the close of the Promotion Period.
ENTRY METHOD 1: VIA SCAN CODE: To enter via scan code, (i) visit a participating Labatt retailer to obtain the scan codes found on specially marked advertisements, (ii) during the Promotion Period, use your smart device to scan the code and open the link to the promotion website, (iii) complete the eligibility requirements (including but not limited to your full name, address and date of birth). No purchase is necessary to scan the code on packaging. There is no cost from the Sponsor for scanning a code, but your cell phone carrier’s data rates may apply. Other charges may also apply; check your cell phone plan for details.
ENTRY METHOD 2: WEBSITE: During the Entry Period, visit www.labattusa.com/OhioHockey. Entries submitted or completed by anyone other than the entrant are void. Sponsor will not verify the entrants the receipt of all entries. Entries made using an automated entry device of any kind will be automatically disqualified without notice. Eligible entries must be received by the close of the Promotion Period. To enter via the internet during the Promotion Period, visit www.labattusa.com/OhioHockey and provide your full name, date of birth, street address (PO Boxes are not acceptable), city, state, zip code, phone number, email address, and agree to the Terms and Conditions. Entries made using automated entry devices of any kind will be disqualified. Eligible entries must be received by the close of the Promotion Period.
PRIZES AND DRAWINGS: On or around 1/7/2024 and subject to confirmation of eligibility, two (2) winners (individually a “Winner” or collectively “Winners”) will be randomly selected from all eligible Entries received during the applicable Entry Period. Winners will be notified by phone, text-message, email, or direct message and all entrants hereby consent to such notification by entering into this Sweepstakes. Each Winner will be awarded one of the following prizes (each a “Prize”, or together “Prizes”): Prize 1: four (4) tickets to one (1) Columbus Hockey regular season home game in 2024, during the 2023-2024 season. Exact game date and seat location to be determined in Sponsor’s sole discretion. The Approximate Retail Value (“ARV”) of Prize 1 is $1,000.00. Prize 2: four (4) tickets to one (1) Toledo Walleye regular season home game in 2024, during the 2023-2024 season. Exact game date and seat location to be determined in Sponsor’s sole discretion. The Approximate Retail Value (“ARV”) of Prize 2 is $100.00. The total ARV of all Prizes is $1,100.00. The odds of winning a Prize will depend on the total number of eligible entries received during the corresponding Entry Period. All Prizes will be awarded unless Sponsor cannot obtain documentation from a potential Winner to prove eligibility in which case all Prizes may not be awarded. Winner is responsible for all costs and expenses incurred that are not specifically stated as being included as part of the Prize including, but not limited to, all taxes, surcharges, and all other costs and expenses not specifically stated as being included. Prize will be mailed to Winner at residence provided by Winner. No alcohol is being awarded as a Prize.
CONDITIONS: Winner must be 21 years of age or older at time of entry. Sponsor need not inform you if you have earned an entry or not. There is a limit of one (1) Winner per household. All Federal, State, and local laws apply. Incomplete entries, entries generated by script, macro or other automated means, or entries which subvert the entry process, in the sole discretion of Sponsor, will not be eligible. All entries must be received during the Promotion Period to be eligible. Message and data rates may apply. The computer clock of the webmaster hosting the Sweepstakes is the official timekeeping device. Sponsor reserves the right to substitute the Prize with a prize of equal or greater value or with a company check in the amount of the ARV for the Prize. If the actual value of the prize is less than the stated ARV, Winner is not entitled to the value of the difference. By accepting the Prize, (i) Winners hereby accept any and all risks associated in using the Prize and (ii) Winners hereby indemnify Sponsor for any injuries, including death, obtained in connection with using the Prize. If requested, Winner must return to Sponsor a signed Affidavit of Eligibility and Liability/Publicity Release. If Sponsor is unable to make contact with or receive personal confirmation from a Winner of being selected as a Winner within three (3) days from the first notification attempt, or if a Winner (i) fails to complete and return all requested documents by the date specified by the Sponsor, (ii) is found to be ineligible, or (iii) fails to comply with the Official Rules, the Prize will be forfeited and an alternate winner will be selected. The acceptance or use of the Prize constitutes permission for Sponsor to use Winner’s name and address (city and state) for promotional purposes on a worldwide basis, and in all forms of media, in perpetuity, without notice or further compensation. All federal, state and other taxes are the responsibility of each Winner. Sponsor does not provide tax advice. Prizes awarded may not be exactly as shown or described. No substitutions are allowed and the Prize may not be transferred, conveyed or auctioned. All Prizes will be awarded unless Sponsor does not receive required documents in a timely manner in which case all Prizes may not be awarded. Winners agree to release, discharge, indemnify, and hold harmless the Sponsor, Instagram, Inc., their respective parent companies and affiliates and their respective directors, officers, employees, and agents, from any claims due to any injuries, damages or losses to any person (including death) or property, resulting in whole or in part from acceptance or use of the Prize, or participation in the Sweepstakes. External links may be subject to additional terms and conditions. Sponsor is not liable for any material, terms, conditions, or any other losses or damages as a result of visiting the external site. No purchase is necessary. A purchase will not increase chances of winning. ENTRANT WARRANTY AND RELEASE: Each entrant warrants that he/she is eligible to participate in this Sweepstakes and has the legal capacity to agree to the terms of these Official Rules. Winner agrees to release, indemnify, and hold harmless the Released Parties from any and all liability, injuries, losses, or damages to any person (including death) or property, arising from or in connection with the awarding, receipt, use, and/or misuse of a prize or participation in any prize-related activity, and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property related cause of action.
LIMITATIONS ON LIABILITY: Released Parties are not responsible for lost, late, jumbled, incorrect, or inaccurate entries, whether caused by any of the equipment or programming associated with or utilized in this Sweepstakes or by any human error. Sponsor is not responsible for any problems or technical malfunction(s) of any telephone network or lines, computer online systems, servers or other services, providers, computer equipment, software, failure of any e-mail, technical problems or traffic congestion on the Internet or at any website (including Instagram), including, without limitation, any injury or damage to participant's or any other person's computer related to or resulting from participation in this Sweepstakes. Sponsor is not responsible for any typographical or other error(s) in administration of the Sweepstakes, or in the selection/announcement of the prize winners. If, for any reason, the Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted where Sponsor deems fit and the prizes will be awarded via random drawing from among all eligible Entries received up until and or after (if applicable) the time of modification, cancellation or termination, or in a manner that is fair and equitable as determined by Sponsor. All Entries become the property of the Sponsor and will not be returned to entrants. The Sweepstakes is subject to all applicable federal, state and local laws. Any person attempting to defraud or in any way tamper with the mechanics or logistics of this Sweepstakes will be declared ineligible and may be prosecuted. Sponsor is not responsible for lost or stolen Prizes. If, for any reason, the Sweepstakes is not capable of being conducted as planned because of tampering, intervention, fraud, technical failures, or any other reason (each an “Intervening Cause”), which affects the security, fairness, or proper execution of the Sweepstakes, Sponsor reserves the right to modify or cancel the Sweepstakes or otherwise award the Prizes through a drawing from all eligible entries received which, in Sponsor’s discretion, were not affected by the Intervening Cause. With regard to the Prize being awarded, Sponsor makes no express or implied warranty of merchantability or fitness for a particular purpose. Prize is awarded “As Is”. Sponsor is not responsible for any damage, malfunctions, missing parts or any other physical or mechanical flaws of Prize. Any photographs used are for illustrational purposes only and may differ from the actual Prize awarded. In the event that a court, or other tribunal of competent jurisdiction, shall hold any of the provisions of these Official Rules to be illegal, invalid, or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Official Rules shall otherwise remain in full force and effect.
DISPUTE RESOLUTION: Any disputes regarding this Sweepstakes shall be governed by New York State law and resolved in State or Federal court located in Erie County, New York. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred but in no event attorneys’ fees. Entrant waives any claim for punitive, incidental and consequential damages. BY PARTICIPATING, EACH ENTRANT UNDERSTANDS AND AGREES THAT HE/SHE MAY BRING A CLAIM AGAINST THE RELEASED PARTIES ON AN INDIVIDUAL BASIS ONLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.
