ELIGIBILITY: The Labatt & Pittsburgh Penguins Pens to Detroit Road Trip Sweepstakes (“Sweepstakes”) begins at 12:00:01 AM Eastern Time ("ET") on 01/01/2023 (“Start Date”) and ends at 11:59:59 PM ET on 03/19/2023 (“End Date”) (“Promotion Period”). Sweepstakes is open to legal residents of Pennsylvania, who are 21 years of age or older at time of entry. This Sweepstakes is sponsored by Labatt USA Operating Co, Buffalo, New York (“Sponsor”). Employees, contractors, directors, and officers of Sponsor, Pittsburgh Penguins LP (“Penguins”), PPG Industries, Inc., AEG Management Pittsburgh, LLC, ARAMARK Sports and Entertainment Services, LLC, their respective parents, subsidiaries, divisions, affiliates (including without limitation, the National Hockey League (“NHL”) and all other member teams), sales representatives, suppliers, distributors and advertising, promotional and judging agencies (collectively, “Released Parties”), any person affiliated with the alcoholic beverage industry, including but not limited to wholesalers and retailers of alcohol products, and their immediate family members (spouses, domestic partners, parents, children, and siblings) and household members of each (whether related or not) are not eligible to participate in or win the Promotion. By participating, entrants agree to these Official Rules and the decisions of the Sponsor.
HOW TO ENTER: During the Promotion Period, there are two (2) ways to enter this Sweepstakes. There is a limit of three (3) entries, per person or a limit of six (6) entries per household, regardless of method of entry during the Promotion Period. You may only win once, regardless of entry method. Entries submitted or completed by anyone other than the entrant are void. Sponsor will not verify to entrants the receipt of all entries. Entries made using an automated entry device of any kind will be automatically disqualified without notice. Eligible entries must be received by the close of the Promotion Period.
ENTRY METHOD 1: VIA QR CODE: To enter via QR code, (i) visit a participating Labatt retailer to obtain the QR codes found on specially marked packages of Labatt Blue and Labatt Blue Light 30-packs, (ii) during the Promotion Period, use your smart device to scan the QR code and open the link to the Sweepstakes website, (iii) complete the entry form (including but not limited to your full name, address and date of birth). No purchase is necessary to scan the code on packaging. There is no cost from the Sponsor for scanning a code, but your cell phone carrier’s data rates may apply. Other charges may also apply; check your cell phone plan for details. Limit: three entries per person or per cell phone number. Entries will be deemed made by the authorized account holder for the mobile phone number used at the time of entry. The “authorized account holder of the mobile phone number” is defined as the natural person who is assigned to the mobile phone number used to enter the Sweepstakes by the mobile phone service access provider associated with the mobile phone number used to enter the Sweepstakes. By submitting the completed entry form during the Promotion Period, you will receive one (1) entry into the Sweepstakes.
ENTRY METHOD 2: WEBSITE: To enter via the internet during the Promotion Period, visit www.labattusa.com/pensroadtrip and provide your full name, date of birth, street address (PO Boxes are not acceptable), city, state, zip code, phone number, and email address. Entries submitted or completed by anyone other than the entrant are void. Entries made using automated entry devices of any kind will be disqualified. Eligible entries must be received by the close of the Promotion Period. By submitting the entry form during the Promotion Period, you will receive one (1) entry into the Sweepstakes.
PRIZES AND DRAWINGS: On or around 03/26/2023 and subject to confirmation of eligibility, one (1) winner (“Winner”) will be randomly selected from all eligible entries received. Winner will be notified by phone, text-message, or email using the contact information provided during entry, and hereby consents to receiving such phone call, text-message, or email by entering this Sweepstakes. Winner will be awarded one (1) prize consisting of the following (collectively, the “Prize”): (i) hotel accommodations for two (2) nights (standard room; double occupancy) valued at $500.00 USD in Detroit, Michigan, (ii) two (2) tickets to Penguins and Detroit Red Wings regular season professional ice hockey game expected to take place on 04/08/2023 in Detroit, Michigan (seat location to be determined in Sponsor’s sole discretion) valued at $200.00 USD, (iii) one (1) gas card valued at $100.00 USD and (iv) Labatt and Penguins wearables valued at $100.00 USD and sizes to be determined solely by Sponsor in Sponsor’s sole discretion.The Approximate Retail Value (“ARV”) of Prize is $900.00. The total ARV for all Prizes to be awarded is $900.00. The odds of winning a Prize will depend on the number of eligible entries received during the Promotion Period. All Prizes will be awarded unless Sponsor cannot obtain documentation from a potential Winner to prove age and residency, in which case all Prizes may not be awarded. Winner is responsible for all costs and expenses not specifically stated as being included herein including, but not limited to, transportation to and from departing airport, parking, tolls, meals, all discretionary spending, upgrades, insurance, all taxes, surcharges, fuel, registration fees, transfer of title, licenses, delivery of Prize, and all other costs and expenses incurred in claiming, registering, or using the Prize. Tangible portions of Prize will be mailed to Winner. Winner assumes all responsibility for the legal and safe operation or handling of the Prize. No alcohol is being awarded as a Prize.
CONDITIONS: Winner and guest (“Guest”) must be 21 years of age or older at time of entry. There is a limit of one (1) Winner per household. Guest will have no independent rights to the Prize. No subsitutions are allowed and the Prize will be invalid if, other than providing a single ticket to Guest, the Winner sells, transfers, or auctions the Prize after receipt. Guest must accompany Winner on the Prize trip. The tickets awarded as a portion of the Prize must be used for the same game. Attendance at the Game is subject to ticket terms and conditions and winner and guests must follow all Sponsor and venue safety protocols, including but not limited to, any and all COVID-19 rules that may be required by the Penguins and/or PPG Paints Arena (e.g., mask policies, negative COVID-19 test requirements, proof of full COVID-19 vaccination status requirements, social distance restrictions, etc.). Sponsor will not be responsible in the event that the winner and/or guest is denied entry to the Game for any reason, including for failure to comply with any applicable venue rules or safety protocols. Game tickets are subject to the additional terms and conditions set by the issuer. Game is subject to, among other things, delay, postponement, rescheduling and cancellation by game coordinators. Sponsor is not responsible if the Game is delayed, postponed or canceled for any reason. In the event of Game postponement, rescheduling or cancellation, the winner will be notified by Sponsor, who may substitute the Prize tickets for tickets to a Game to take place at a later date, to be determined at Sponsor’s sole discretion. All Federal, State, and local laws apply. Incomplete entries, entries generated by script, macro or other automated means, or entries which subvert the entry process, in the sole discretion of Sponsor, will not be eligible. All entries must be received during the Promotion Period to be eligible. Message and data rates may apply. The computer clock of the webmaster hosting the Sweepstakes is the official timekeeping device. Sponsor reserves the right to substitute the Prize with a prize of equal or greater value or with a company check in the amount of the ARV for the Prize. If the actual value of the prize is less than the stated ARV, Winner is not entitled to the value of the difference. By accepting the Prize, (i) Winners hereby accept any and all risks associated in using the Prize and (ii) Winners hereby indemnify Sponsor for any injuries, including death, obtained in connection with using the Prize. Each Winner, and Winner’s Guest, if any, will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release within three (3) days from the date of receipt. If Sponsor is unable to make contact with or receive personal confirmation from a Winner of being selected as a Winner within three (3) days from the first notification attempt, or if a Winner (i) fails to complete and return all requested documents by the date specified by the Sponsor, (ii) is found to be ineligible, or (iii) fails to comply with the Official Rules, the Prize will be forfeited and an alternate winner will be selected. The acceptance or use of the Prize constitutes permission for Sponsor to use Winner’s name and address (city and state) for promotional purposes on a worldwide basis, and in all forms of media, in perpetuity, without notice or further compensation. All federal, state and other taxes are the responsibility of each Winner. Sponsor does not provide tax advice. Prizes awarded may not be exactly as shown or described. No cash or other substitutions are allowed and the Prize may not be transferred, conveyed or auctioned. Winner will not receive compensation from Sponsor for Prize items that the Winner is unable to use, including, without limitation, due to Winner’s or guest’s unavailability or due to cancellation or postponement of the Game. All Prizes will be awarded unless Sponsor does not receive required documents in a timely manner in which case all Prizes may not be awarded. All expenses and costs associated with the acceptance or use of the Prize that are not expressly specified in these Official Rules as being part of the Prize are the sole responsibility of the Winner, including, without limitation, transportation to/from the Game. Winners agree to release, discharge, indemnify, and hold harmless the Sponsor, Instagram, Inc., their respective parent companies and affiliates and their respective directors, officers, employees, and agents, from any claims due to any injuries, damages or losses to any person (including death) or property, resulting in whole or in part from acceptance or use of the Prize, or participation in the Sweepstakes. External links may be subject to additional terms and conditions. Sponsor is not liable for any material, terms, conditions, or any other losses or damages as a result of visiting the external site. All information provided to enter this Sweepstakes is subject to Sponsor’s Privacy Policy which can be found at www.fifcousa.com/privacy-policy. If you are selected as a winner, your personal information may be included on a publicly available winner’s list. If required by law, Winner will be issued a 1099 tax form for the Prize value.
NHL RULES: These Official Rules shall in all respects be subject to and subordinate to each of the following, as such may be amended from time to time: (a) the NHL Constitution; (b) the NHL By-laws; (c) all other rules, regulations and policies of the NHL and the resolutions of its Board of Governors; (d) any collective bargaining agreement between the NHL and/or its member clubs and other parties; (e) all consent decrees and settlement agreements entered into, between or among the NHL and its member clubs or the NHL, NHL member clubs and/or other persons in furtherance of NHL business or interests or as otherwise authorized directly or indirectly by the NHL Board of Governors, the NHL Commissioner, or the NHL Constitution; (f) any television or cable, radio, or other media network agreements between the NHL and third parties; and (g) any national corporate marketing, licensing, sponsorship or similar agreements between the NHL (or NHL affiliates) and third parties, all as the same may now exist or hereafter be amended or enacted or as they may be interpreted by the Commissioner.
In the event of a dispute as to any registration, the Authorized account holder of the email account used to register the email account will be deemed to be the registrant. “Authorized account holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. The potential winner may be required to show proof of being the Authorized account holder of the account associated with the winning entry.
AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE SWEEPSTAKES SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND COMPLIANCE WITH THE OFFICIAL RULES HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
ENTRANT WARRANTY AND RELEASE: Each entrant warrants that he/she is eligible to participate in this Sweepstakes and has the legal capacity to agree to the terms of these Official Rules. By accepting Prize, Winner and Guest agree to release, indemnify, and hold harmless the Released Parties from any and all liability, injuries, losses, or damages to any person (including death) or property, arising from or in connection with the awarding, receipt, use, and/or misuse of a prize or participation in any prize-related activity, and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property related cause of action. LIMITATIONS ON LIABILITY: Released Parties are not responsible for lost, late, jumbled, incorrect, or inaccurate entries, whether caused by any of the equipment or programming associated with or utilized in this Sweepstakes or by any human error. Sponsor is not responsible for any problems or technical malfunction(s) of any telephone network or lines, computer online systems, servers or other services, providers, computer equipment, software, failure of any e-mail, technical problems or traffic congestion on the Internet or at any website (including Instagram), including, without limitation, any injury or damage to participant's or any other person's computer related to or resulting from participation in this Sweepstakes. Sponsor is not responsible for any typographical or other error(s) in administration of the Sweepstakes, or in the selection/announcement of the prize winners; unauthorized human intervention in any part of the entry process or the Sweepstakes; late, lost, undeliverable, damaged or stolen mail; or any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any Prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, if it is possible. If, for any reason, the Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted where Sponsor deems fit and the prizes will be awarded via random drawing from among all eligible entries for the Promotion Period received up until and or after (if applicable) the time of modification, cancellation or termination, or in a manner that is fair and equitable as determined by Sponsor. All entries become the property of the Sponsor and will not be returned to entrants. The Sweepstakes is subject to all applicable federal, state and local laws. Any person attempting to defraud or in any way tamper with the mechanics or logistics of this Sweepstakes will be declared ineligible and may be prosecuted. Sponsor is not responsible for lost or stolen Prizes. If, for any reason, the Sweepstakes is not capable of being conducted as planned because of tampering, intervention, fraud, technical failures, or any other reason (each an “Intervening Cause”), which affects the security, fairness, or proper execution of the Sweepstakes, Sponsor reserves the right to modify or cancel the Sweepstakes or otherwise award the Prizes through a drawing from all eligible entries received which, in Sponsor’s discretion, were not affected by the Intervening Cause. With regard to the Prize being awarded, Sponsor makes no express or implied warranty of merchantability or fitness for a particular purpose. Prize is awarded “As Is”. Sponsor is not responsible for any damage, malfunctions, missing parts or any other physical or mechanical flaws of Prize. Any photographs used are for illustrational purposes only and may differ from the actual Prize awarded. In the event that a court, or other tribunal of competent jurisdiction, shall hold any of the provisions of these Official Rules to be illegal, invalid, or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Official Rules shall otherwise remain in full force and effect.
DISPUTE RESOLUTION: Any disputes regarding this Sweepstakes shall be governed by New York State law and resolved in State or Federal court located in Erie County, New York. BY PARTICIPATING, EACH ENTRANT UNDERSTANDS AND AGREES (1) THAT HE/SHE MAY BRING A CLAIM AGAINST THE RELEASED PARTIES ON AN INDIVIDUAL BASIS ONLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES, BUT IN NO EVENT ATTORNEYS’ FEES; AND (3) UNDER NO CIRCUMSTANCES WILL ENTRANTS BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANTS HEREBY WAIVE ALL RIGHTS TO CLAIM, INDIRECT, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.
